These Terms of Use ("Terms") govern your access to and use of Hidden Gems ("Service"), operated at https://hiddengems.aitools.rs. By using the Service, you agree to be bound by these Terms.

1. Description of Service

Hidden Gems provides AI-generated walking tour itineraries focused on lesser-known, local places ("hidden gems"). Tours are generated by a large language model (Claude by Anthropic) and are intended for informational and entertainment purposes.

2. Eligibility

You must be at least 16 years old to use this Service. By creating an account, you represent that you meet this requirement. If you are under 18, you should have parental or guardian consent.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate, complete, and current information when registering.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, scrape, or abuse the AI generation pipeline.
• Submit harmful, offensive, or misleading inputs.
• Impersonate any person or entity.
• Use automated bots or scripts to generate tours at scale without written permission.
• Attempt to circumvent any security measure.

5. AI-Generated Content Disclaimer

Tours are generated by an AI model and may occasionally contain inaccuracies, outdated information, or places that are temporarily closed. We do not guarantee the accuracy, completeness, or availability of any recommended place. Always verify opening hours and accessibility independently before visiting.

Hidden Gems is not responsible for any injury, loss, or damage resulting from following an AI-generated tour itinerary.

6. Intellectual Property

The Hidden Gems name, logo, website design, and source code are our intellectual property. AI-generated tour content is provided to you under a non-exclusive, personal, non-transferable licence for your own use only.

7. Third-Party Services

The Service relies on third-party APIs (Anthropic, Google Maps). Your use of those services is subject to their own terms and policies. We are not responsible for the availability or accuracy of those services.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Limitation of Liability

To the maximum extent permitted by law, Hidden Gems and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.

Our total liability to you for any direct damages shall not exceed €50 or the amount you paid us in the preceding 12 months, whichever is greater.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraud, or any other reason at our sole discretion. You may delete your account at any time by contacting us.

11. Changes to Terms

We may modify these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which our company is registered, without regard to conflict-of-law principles. Any dispute shall be resolved through good-faith negotiation first, and thereafter through the competent courts of that jurisdiction.
